What Build America, Buy America (BABA) Means
The Build America,Buy America (BABA) Act, part of the Bipartisan Infrastructure Law, says that when the government provides money for building things like roads and bridges, the materials used to build them should be made in the United States.
On January 14, 2025, the FHWA rescinded the Manufactured Products General Waiver for Buy America requirements that had been in place since 1983. To qualify as “produced in the United States” and be fully Buy America‐compliant, a manufactured product must:
- Be manufactured in the United States (“final assembly requirement”), and
- Have more than 55% of its components, by cost, be mined, produced, or manufactured in the United States (“55% requirement”).
FHWA has decided to allow a grace period to allow manufacturers to come into compliance with the rules.
- For Federal aid projects obligated on or after October 1, 2025: Manufactured products must be assembled in the US, but do not need to meet the 55% requirement.
- For Federal aid products obligated on or after October 1, 2026: Manufactured products must be assembled in the US and meet the 55% requirement.
Embracing BABA
