Buy America Requirements Final Rule
Earlier this year, the U.S. Department of Transportation’s Federal Highway Administration (FHWA) rescinded the Manufactured Products General Waiver for Buy America requirements.
The final Buy America rule is now effective as of March 17th.
As a reminder, the new rule will be rolled out in two phases:
1. For Federal aid projects obligated on or after October 1st, 2025: Manufactured products must be assembled in the U.S., but do not need to meet the 55% requirement.
2. For Federal aid products obligated on or after October 1st, 2026: Manufactured products must be assembled in the U.S. and meet the 55% requirement.
